These Terms of Service (“Terms”) govern your access to and use of the website getmarriagemagic.com (the “Site”) and the coaching and educational services (the “Services”) provided by It's Never Too Late Courses, LLC, doing business as Marriage Magic (“Company,” “we,” “us,” or “our”). By using the Site or enrolling in the Services, you agree to these Terms.
1. The Services
The Company provides online coaching programs and educational content, including group coaching programs and related materials. Specific program details, deliverables, and pricing are described at the time of enrollment.
2. Coaching Is Not Therapy, Medical, Legal, or Financial Advice
Please read this section carefully. The Company provides coaching and educational services only. Coaching is not psychotherapy, counseling, marriage or family therapy, mental health treatment, or medical care, and it is not a substitute for the services of a licensed therapist, counselor, psychologist, physician, or other healthcare professional.
Although the Company's founder holds professional licenses and certifications, when providing Services through the Company she acts solely in the capacity of a coach. No therapist-client, counselor-client, or doctor-patient relationship is created through the Services, and the Services do not include the diagnosis or treatment of any mental, emotional, or physical health condition.
If you are experiencing a medical or mental health emergency, contact a licensed professional or emergency services immediately. The Company does not provide legal or financial advice; consult a qualified attorney or financial professional for those matters.
3. No Guarantee of Results
Coaching outcomes depend on many factors, including your own participation, effort, and individual circumstances. The Company does not guarantee any specific result, including but not limited to the saving, restoration, or improvement of any marriage or relationship. Any testimonials, case studies, or examples reflect individual experiences and are not a promise or guarantee that you will achieve similar results. Client stories, case studies, and examples shared in our marketing and programs may be composites based on real experiences, with names and identifying details changed to protect privacy.
4. Eligibility
You must be at least 18 years old to use the Services. By enrolling, you represent that you are 18 or older and able to enter into a binding agreement.
5. Payment Terms
• Fees, payment options, and any payment plans are presented at the time of enrollment, and you agree to pay the amounts due.
• If you enroll on a payment plan, you authorize us (through our payment processor) to charge each scheduled payment when due.
• You are responsible for keeping your payment information current. Failed or late payments may result in suspension of access until the balance is resolved.
• Refund Policy: All sales are final, and program fees are non-refundable once you enroll. If you are on a payment plan, you remain responsible for the full balance of the agreed fees.
6. Client Responsibilities
You agree to participate in good faith, to provide accurate information, and to use the Services for their intended purpose. You are responsible for your own decisions and actions.
7. Intellectual Property
All program content, materials, frameworks, methods (including any proprietary methods and trademarks), recordings, and written materials provided through the Services are the property of the Company and are protected by intellectual property laws. You receive a limited, personal, non-transferable license to use them for your own learning. You may not copy, share, resell, record, or distribute the materials without our written permission.
8. Confidentiality
We respect the confidentiality of personal information you share in the course of coaching, subject to our Privacy Policy and applicable law. In group settings, you agree to keep other participants' shared information confidential. Please note that coaching confidentiality is not the same as legally privileged communications with a licensed therapist or attorney.
9. Communications Consent
By providing your contact information, you consent to receive communications from us related to the Services. Text-messaging consent and opt-out are described in our Privacy Policy.
10. Limitation of Liability
To the fullest extent permitted by law, the Company and its founder, employees, and contractors will not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Site or Services. Our total liability for any claim will not exceed the amount you paid to us for the Services giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless the Company and its founder, employees, and contractors from any claims, damages, or expenses arising out of your use of the Services or violation of these Terms.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in the State of Georgia, and you consent to the personal jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. The Effective Date above reflects the most recent version. Continued use of the Site or Services means you accept the updated Terms.
[14. SMS Terms for Marriage Magic:
You can cancel the SMS service at any time. Just text "STOP" to the phone number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly.
Carriers are not liable for delayed or undelivered messages
As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive only essential messages. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
